You must understand and agree to the following facts, terms and conditions:

The software used to build and manage your Website is a product of  Cityguidemarketing.com ...

Cityguidemarketing.com does not sell any software to you. Cityguidemarketing.com  leases its system to you to be used in the act of creating and publishing your Website on the Internet.

Cityguidemarketing.com allows you to upload your information and images to your Website, using our system. However, you must first agree to follow all legal rules regarding content. These rules include the following:

You may not upload anything that :
(a) may be considered deceptive
(b) may be defamatory, degrading, libelous, lewd, pornographic or obscene as determined by Cityguidemarketing.com ...
(c) may be racist, threatening, harassing, libelous, or a violation of intellectual property laws ...
(d) promotes stolen, pirated or unlicensed copyrighted material ...
(e) violates any laws regarding unfair competition, anti-discrimination or false advertising ;
(f) contains viruses, Trojan horses, worms, time bombs, cancel bots or other similar harmful programming routines ...
(g) infringes on any third party copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy;
(h) violates any applicable laws, statutes, ordinances, regulations or promotes anything that can be construed as illegal activity;

You may NOT send or use the following types of Emails or Advertising:
( a ) Spam Emails, opt-in emails, unsolicited emails, pseudo emails, impersonating emails, purchased email lists or other unwanted, unsolicited emails sent out in a bulk format using our software to email addresses ( persons ) that have not joined Your email list through the following ways ... The customer must have already heard of you or your company and be familiar with it, they must have joined your email list willfully by purchasing a product or service from you or your company, or they must have signed up for your specific online offerings or services as with a newsletter.
( b ) We do not allow Pop-Under Advertisements or any other form of deceptive or annoying advertisements linking or concerning your website that may impair or hurt the overall image or service of the Cityguidemarketing.com  Branded System .

Approved Advertising Methods:
You may advertise your website in any measure or method viewed as appropriate by Cityguidemarketing.com  within our guidelines such as with most traditional forms of advertising that are in good taste and form as to not hurt or impair the overall image or service of the Cityguidemarketing.com  Branded Name and Web Solution Systems ... Approved specific methods of advertising on the World Wide Web include Search Engine Submissions, Banner Ads, Pay Per Click Services, Classified Ads and various Affiliate Programs ... Any questionable methods other than these will have to be approved by Cityguidemarketing.com ...

Allowed Space and Usage :
You receive 15MB of storage space for pages and graphics, enough for over 150 pages, which will easily exceed most business needs ... We don't confuse you with math equations and computations, we simply allow up to 5,000 unique visitors per month for the monthly fee, additional visitors are billed in blocks of 5,000 visitors per $ 25.00 ... You can check how many visitors you have at any and all times simply by logging into your Manager's Console and looking under Site Statistics ...

All Actions deemed to be in violation of any of these rules are subject to Removal by Cityguidemarketing.com. It is within our sole discretion to publish any and or all websites live to the Internet for viewing ... 

To clarify further: Cityguidemarketing.com Internet services are all Client/Server systems, which means that all software code remains on Cityguidemarketing.com  servers at all times. You are leasing our system for use in selling your products or services.

Cityguidemarketing.com will provide a secure, password-protected manager console from which you, the client may update, add to and remove items as well as retrieve orders placed.  You must keep your password private at all times. If your password is compromised and you can not change it using the manager console, you agree to contact  Cityguidemarketing.com  immediately to change your password .

Cityguidemarketing.com  will not be held responsible for neither down time nor damages resulting from downtime .

- Free 15 Day Trial Run Sites:  are considered as a "Try-Out" period and are offered as a way for the Customer to try the Sites out before purchasing or activating a Site. The Trial Run period ends when a Site is purchased or when the 15 Day Trial Run Period is over, whichever comes first ...

- REFUNDS:  Any and All applicable Setup, Installation and Hosting Fees are non-refundable, especially for Custom Setup Websites, where we cannot refund our time and labor ...

Cityguidemarketing.com does not allow for the Resale of the Cityguidemarketing.com System by the Customer, nor does Cityguidemarketing.com sell the source code of the system. Only officially authorized Resellers are allowed to resell websites using our system ...

You authorize Cityguidemarketing.com  to charge either your credit card or do an ACH billing which automatically deducts from your checking account.  You can pay monthly, quarterly or annually. This hosting agreement renews every month or according to your agreed upon terms unless cancelled or stated otherwise in writing by you ... If you have chosen an Annual Hosting, please understand that there are no refunds for setup fees or hosting fees cancelled at any time during the Annual contract.  Also, You may choose to not renew any Hosting Fees by sending written notice at any time ... We do ask for 30 days notice on cancellations whenever possible ...
